Terms and Conditions for Mailbox Heroes

Welcome to Mailbox Heroes! These Terms and Conditions ("Terms") govern your use of our services and outline the agreement between you ("Client" or "you") and Mailbox Heroes ("we," "us," or "our"). By engaging with our services, you agree to comply with and be bound by these Terms. Please read them carefully.
1. Services Provided
Mailbox Heroes is an advertising company based in southwest Michigan that specializes in designing and distributing marketing materials for small businesses. Our services include:
Designing custom advertisements for your business.
Placing your ad on a postcard.
Delivering the flyer to thousands of residential homes within the city of your business that fits your target market.
Printing: Flyers, brochures, door hangers, Rrack cards, yard signs, envelopes, letterheads, new mover, and community postcards.
We reserve the right to modify or discontinue any part of our services at any time without prior notice.
2. Client Responsibilities
By using our services, you agree to:
Provide accurate and complete information about your business, including target market details, branding guidelines, and advertising content.
Submit all required materials (e.g., logos, images, text) by the agreed-upon deadlines.
Ensure that all content provided complies with applicable laws and does not infringe on any third-party rights (e.g., copyrights, trademarks).
Notify us of any changes to your business information or advertising needs in a timely manner.
3. Payment Terms
Payment for services must be made in full prior to the design and distribution of your advertisement, unless otherwise agreed in writing.
We accept payment via Paypal, Apple Pay, ACH Bank Transfer, and Credit Cards.
Late payments may result in a delay or suspension of services.
4. Intellectual Property
All designs, flyers, and marketing materials created by Mailbox Heroes remain our intellectual property until full payment is received. Upon payment, you are granted a non-exclusive license to use the materials for your business purposes.
You retain ownership of any content (e.g., logos, images, text) you provide to us.
5. Limitation of Liability
Mailbox Heroes will make every effort to ensure the accuracy and quality of our services. However, we are not responsible for any errors, omissions, or delays in delivery beyond our control.
We are not liable for any direct, indirect, incidental, or consequential damages resulting from the use of our services.
You agree to indemnify and hold Mailbox Heroes harmless from any claims, damages, or losses arising from your use of our services or any content you provide.
6. Delivery and Distribution
We guarantee delivery of postcards and printed prodcuts to thousands of residential homes within your business's city. However, we cannot control factors such as weather, postal service delays, or other unforeseen circumstances that may affect delivery.
Distribution is based on your target market criteria, as provided by you.
7. Cancellation and Refunds
If you wish to cancel your service, you must notify us in writing at least 30 days before the scheduled distribution date.
Refunds are only available if cancellation is made within the specified timeframe and before the design process has begun. No refunds will be issued after the postcards and/or printed products have been designed or distributed.
8. Privacy Policy
Your privacy is important to us. Please refer to our Privacy Policy for details on how we collect, use, and protect your information.
9. Amendments to Terms
We reserve the right to update or modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our services constitutes acceptance of the revised Terms.
10. Governing Law
These Terms are governed by the laws of the State of Michigan. Any disputes arising from these Terms or our services will be resolved in the courts of southwest Michigan.
